In a complaint filed on December 29, 2023, at the top court of the United Nations, South Africa accused Israel of committing genocide against Palestinians in Gaza and requested that the court force Israel to stop its airstrikes.
In their statement to the International Court of Justice, South Africa claims “acts and omissions by Israel … are genocidal in character” when they have the intention of committing “to destroy Palestinians in Gaza as a part of the broader Palestinian national, racial and ethnic group.”

Additionally, it requests that an interim injunction be issued by the Hague-based court for Israel to immediately cease its military operations in Gaza.
Given that both South Africa and Israel are parties to the Genocide Convention, the lawsuit may be brought under its provisions.
